Terms of Use

These terms are the agreement between Uju Cakes (“Uju Cakes”, “we”, “us”, “our”), a sole proprietorship, and you, the person browsing this website or ordering from us.

They apply when you use this website and when you place an order. By sending an order request or paying a deposit, you confirm that you have read and accepted them.

They are governed by the law of the Republic of South Africa. Nothing in them limits any right you have under the Consumer Protection Act 68 of 2008 (“CPA”). Where a term here conflicts with a right the CPA gives you, the CPA wins.

A quote is not an orderthe estimate the order builder on this site produces is an indication based on our price list. It is not a quote and not a contract. Uju confirms a firm price in writing before anything is baked.

Quote validitya written quote is valid for 14 days from the date we send it, unless it says otherwise.

When an order is confirmedyour order is only confirmed once we have (a) agreed the design, flavour, size and collection or delivery date in writing, and (b) received your deposit. Dates are not held until both are done.

Noticewe ask for at least 7 days’ notice for a custom cake, and more for large or heavily decorated cakes and for wedding work. We will always tell you if we cannot make a date.

Pricesall prices are in South African Rand and include VAT where we are required to charge it.

Deposita 50% deposit confirms your date. The balance is payable before collection or delivery unless we have agreed otherwise in writing.

Changes after confirmationwe will do our best to accommodate changes to a confirmed order, but changes to size, flavour or design may change the price, and we may not be able to make changes close to the date. Any price change will be agreed with you in writing first.

Non-paymentif the balance is not paid, we are not obliged to release the cake.

Cakes are made to order and perishable, and the ingredients and the working time are committed well before the collection date. The scale below reflects that, and is set under section 17 of the CPA, which allows a reasonable cancellation penalty on an advance booking.

• More than 14 days before the date: your deposit is refunded in full, less any non-recoverable costs already incurred on your order (for example a custom topper or a special-order ingredient).
• 7 to 14 days before the date: we retain 50% of the deposit.
• Less than 7 days before the date: we retain the full deposit, because the date can no longer realistically be resold and ingredients have been bought.
• On or after the day of collection: the full price is payable.

If we cancelif we cannot fulfil your order for any reason, you get a full refund of everything you have paid, including the deposit. We will tell you as soon as we know.

If something is wrong with your cakethe CPA gives you the right to goods of good quality. If your cake is not, tell us within 24 hours of collection or delivery and send a photograph if you can. We will agree a fair remedy with you: a repair, a replacement or a refund. Please keep the cake, as we may need to see it.

Change of mindbecause every cake is made to your specification, we cannot accept a return simply because you have changed your mind once baking has started.

Tell us before you orderyou must tell us about any allergy or dietary requirement in writing before your order is confirmed. We cannot add this after the fact.

Our kitchen is not allergen-freewe handle wheat, eggs, dairy, nuts, peanuts, soya and sesame. We cannot guarantee that any cake is free from traces of any allergen, even if the recipe does not contain it. If an allergy is severe, please do not order.

Non-edible partssome decorations, such as dowels, wires, ribbons, toppers, flowers and supports, are not edible and must be removed before serving. We will point these out on collection or delivery.

After it leaves uscakes are fresh and perishable. Once a cake has been handed over, keeping it at a safe temperature and serving it in good time is your responsibility. We will give you storage guidance with every cake.

Collectionplease collect at the agreed time. Bring a flat, level boot space, because a cake on a car seat will not survive the trip.

Deliverydelivery is quoted separately and depends on distance and the size of the cake. The fee is confirmed in writing before your order is confirmed.

Risk passes on handoveronce a cake has been handed to you or to someone you nominated, or set up at your venue, responsibility for it passes to you. We are not liable for damage after that point, including damage in transit in your own vehicle or by a venue or third party.

Accessfor a delivery you must give us a correct address, a contact number and reasonable access. If we cannot deliver because of wrong details or no access, the cake remains payable in full.

Inspiration imagesif you send us a photograph of another baker’s cake, we will treat it as a guide and not copy it. Every cake is handmade, so yours will be a version of the idea rather than an identical reproduction. Colours, flowers and finishes vary.

You warrant your materialif you give us artwork, logos, photographs or wording to put on a cake, you confirm you have the right to use them, and you indemnify us against any claim that we infringed someone’s rights by using what you gave us.

Our photographswe may photograph cakes we make and use those photographs on this website, on social media and in our portfolio. Tell us in writing before your date if you would rather we did not, and we will not.

This websitethe content, images, branding and design of this website belong to Uju Cakes or our licensors, and may not be copied or reused without permission.

Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded, including your rights under the CPA.

Subject to that, our liability for any order is limited to the price you paid for that order. We are not liable for indirect or consequential loss, such as the cost of an event that did not go ahead.

We are not liable for a failure or delay caused by something genuinely outside our reasonable control, such as load-shedding beyond our backup capacity, a supplier failure, extreme weather, illness or a public emergency. If that happens we will tell you as soon as we can and refund you in full if we cannot deliver.

We try to keep this website accurate and available, but we do not warrant that it will be uninterrupted or error-free, and the photographs are illustrative because cakes are handmade and will vary.

The order builder’s estimate is generated from our price list and is not a quote.

We may update these terms. The version on this page at the time you place an order is the version that applies to that order.

If something has gone wrong, please contact us first. Most things are sorted out quickly and directly.

If we cannot resolve it between us, you may refer the matter to the National Consumer Commission or to a recognised consumer goods ombud. Otherwise these terms are governed by South African law and the South African courts have jurisdiction.
